Are You Exempt from the 60-Day Immigration Ban?

Were you outside of the U.S. at 11:59 PM EDT on April 23rd? Unless you had official travel authorization, you are most likely ineligible for a green card until June 21, 2020.

This ineligibility is the result of President Trump’s recent executive order, which pauses immigration for 60 days. The ban applies to green card petitions sponsored by either family members or employers.

Fortunately, the executive order provides a long list of exceptions to the ban. Your permanent residency application may not be affected if:

  1. You were already in the U.S. when the ban took effect (see the above date)
  2. You were outside of the U.S. when the ban took effect, but you had advance parole or some other form of travel authorization
  3. You are a refugee or asylum-seeker
  4. You are the child or spouse of a U.S. citizen
  5. You are the prospective adoptee of a U.S. citizen, pursuant to the IR-4 or IH-4 visa
  6. You are a member of the U.S. Armed Forces
  7. You are a Special Immigrant visa applicant
  8. You are deemed essential for COVID-19 purposes (i.e. you are coming to the U.S. as a doctor, nurse, medical researcher, etc.)
  9. Your immigration advances certain national or law enforcement interests
  10. You are applying for the immigrant investor visa (EB-5)
  11. You are the child or spouse of #6-8

Unfortunately, the President has said he will assess the situation at the end of the 60 days and decide whether or not to extend the ban. Additionally, the administration may choose at the 30-day mark to ban nonimmigrants, as well. A nonimmigrant is a person who is applying for a temporary visa, rather than a green card.
